Membership Agreement
ARTICLE 1. PARTIES
This Membership Agreement is signed by “ANFECA Yazılım ve Danışmanlık Ltd.Şti.“located at Acıbadem Mahallesi Asafbey Sokak İmer Apt. No: 7/A Kadıköy, İstanbul” (Hereinafter referred to as “ANFECA”) and the customer (Hereinafter referred to as “member”) who requested to benefit from the services to be provided within the scope of this Membership Agreement on the website www.kackurus.com and whose information is specified in the membership form (Hereinafter referred to as “Membership Form”) which is Annex 1 of this Membership Agreement.
ARTICLE 2. DEFINITIONS
- Service/Services: The practices defined in this Membership Agreement and its Annexes and put forward by ANFECA
- Site: Refers to the www.kackurus.com domain website belonging to ANFECA.
- Service/Services: Refers to the services that "members" can access via the Site within the scope of becoming a member of ANFECA in order to publish advertisements on the "Site".
- User/Users: To review the advertisements, visit the "Site".
- Member/s: Real persons and legal entities who become members of the "Site" in accordance with the terms of this agreement and benefit from the content, applications and "Services" on the "Site".
- Corporate Member: Real persons and legal entities who become members by providing their commercial and personal information to the "Site" and have their advertisements published (real estate agencies, banks, construction companies, dormitories)
- Individual Member: Real persons and legal entities who become members by providing their personal information to the site and have their advertisements published
- Site: The website where ANFECA offers the "Services" the scope of which is determined by this agreement and can be accessed from the domain name “www.kackurus.com” and its subdomains.
- Mobile Application: Software downloaded from the App Store and Google Play Store to access the Site from mobile devices.
- Member Profile Page: A special page for members where members can perform the necessary transactions in order to benefit from various applications on the "Site" and the "Services", and where they enter their personal information and the information requested by them on an application basis, and which can only be accessed with the username and password determined by the member.
- The third Person: Any person other than ANFECA natural persons and legal entities.
- Personal Data: Refers to the definition of personal data made in the Law on the Protection of Personal Data No. 6698 (hereinafter referred to as "KVKK").
ARTICLE 3. SUBJECT AND SCOPE OF THE AGREEMENT
The subject of this Membership Agreement is the publication, listing and display of advertisements of members who want to carry out similar transactions for the rental and sale of their real estate through the Site and mobile application owned and managed by ANFECA. The terms and conditions of providing the Services to the members regarding the presentation of the options and the use of the Service Packages that the members may purchase in order to benefit from the Services and the rights and obligations of the Parties within this scope.
ANFECA aims to publish the advertisements for the rental and sale of real estates on the Site in accordance with this Membership Agreement, provided that the members obtain the necessary rights and authorization to perform the said transactions through the Site, and to bring together the persons interested in the real estates in question with the members through the Site. ANFECA's provision of Services to the member within the scope of this Membership Agreement does not under any circumstances constitute any commitment regarding the benefit to be obtained by the member through the advertisements, the uninterrupted operation of the system or the fact that it will meet certain expectations of the member. ANFECA shall have no obligations under this Membership Agreement due to the communication and relationship to be established between the members and the persons who visit the Site and are interested in the relevant real estates.
ARTICLE 4. MUTUAL RIGHTS AND LIABILITIES OF THE PARTIES
4.1. ANFECA will evaluate the persons who have completely filled out the Membership Form in Annex 1 of this Membership Agreement and find these persons suitable for membership.
